ELECTRONIC COMMUNICATIONS & ELECTRONIC SIGNATURE DISCLOSURE AND CONSENT

Introduction:

The Electronic Signatures in Global and National Commerce Act (ESIGN) requires your approval before we can provide services to you electronically. This agreement and disclosure specifically governs your consent to accept electronic delivery of disclosures and do business electronically for this loan request. In connection with your loan application and any loan that we may make to you, you have the option to receive important information about your application and/or loan electronically. Please read this Electronic Records and Electronic Signature Disclosure carefully and save or print a copy for your records. You agree to be bound by all terms and conditions contained herein, which are in addition to the terms and conditions in our other agreements with you.

Definitions:

In this agreement and disclosure, the words “you”, “your”, and “yours” mean each and every one who utilizes our electronic records. The words “we”, “us”, “our” and “Credit Union” mean Tulsa Federal Credit Union. “Disclosure” refers to any disclosures that we would normally provide to you in a written form that you retain including information related to your application for credit, our decisions related to your application, terms and conditions that govern any loan we make to you and all related disclosures. “Access Device” means any electronic access device such as a personal computer or mobile banking device such as a mobile phone. “Application” refers to the new loan you are requesting with us upon completion of the new loan application process for either a pre-approval or new loan. Any and all electronic disclosures, communications, and signatures are collectively referred to as “Electronic Communications.”

Electronic Signature (E-Signature):

By clicking the “Consent” button below you specifically agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action while using any electronic service we offer; or in accessing or making any transactions regarding any agreement, acknowledgement, consent, terms, disclosures or conditions constitutes your Electronic Signature “E-Signature”, acceptance and agreement as if actually signed by you in writing. Further, you agree that no certification authority or other third party verification is necessary to validate your E-signature; and that the lack of such certification or third party verification will not in any way affect the enforceability of your signature or resulting contract between you and the Credit Union. You understand and agree that your E-Signature executed in conjunction with the electronic submission of your application shall be legally binding and such transaction shall be considered authorized by you.

Consent:

By clicking the “Consent” button below, you (including any co-applicants) acknowledge receipt of this Electronic Communications Disclosure and Consent form, and consent to the delivery of Electronic Communications either via the internet or an email we send to you. You agree that you are applying for a loan and that your consent to this Electronic Communications and Electronic Signature Disclosure and the submission of the loan application constitutes desire to have us request your credit report and underwrite your application for a loan decision. You also confirm that you meet the Hardware and Software Requirements listed below and are able to access and retain Electronic Communications from us. Your Consent to Electronic Communications applies only to Electronic Communications that we provide to you in connection with your loan application and any loan that we may make to you.

Withdrawing Consent:

You can elect to withdraw your consent at any time by writing to us at Tulsa Federal Credit Union, P.O. Box 267, Tulsa OK 74101 or by calling us at 800-256-5626 or 918-610-0200 or by emailing us at memberservices@tulsafederalcu.org. If you withdraw your consent, the legal validity and enforceability of prior Electronic Communications will not be affected.

Hardware and Software Requirements:

To receive Electronic Communications, you will need to ensure that you are able to receive information electronically and retain it. You must have an access device with an Internet Web browser and Adobe Acrobat Reader in order to receive disclosures electronically. The minimum requirements are Internet Explorer 7.0, Chrome 14, Safari 2 and Adobe Reader 8; hardware capable of running this software; a printer to print or the ability to save your electronic disclosures to your computer. We recommend using the most current versions of these browsers and applications. Further, you must have a printer capable of printing any disclosure or statement that are made available on our website and/or emailed to you, and/or have the ability to electronically save and visually display on your access device such documents. If the hardware or software requirements to communicate with you electronically change and materially affect your ability to access or receive communications electronically, we will notify you of the change; if you do not agree to the changes required; you may withdraw your consent for electronic disclosures.

Copies:

You may request a paper copy of any Electronic Communication. If you wish to obtain a paper copy of any of the Electronic Communications, you may contact us by writing to us at Tulsa Federal Credit Union, P.O. Box 267, Tulsa OK 74101 or by calling us at 800-256-5626 or 918-610-0200 or by emailing us at memberservices@tulsafederalcu.org. If you request a paper copy in addition to the electronic record, a fee may be assessed in accordance with our fee schedule.

Updating Contact Information:

You are responsible for ensuring that we have your current email address for purposes of receiving Electronic Communications. If your email address changes, contact us at 800-256-5626 or 918-610-0200 or log into Home Banking and click the “update” button next to your current email address. If you fail to notify us of any change in your email address, you agree that we may provide Electronic Communications to you at the email address maintained in our records and provided by you.

By clicking the Consent link below this box, I /we agree that submitting an application for a loan electronically constitutes my E-signature and further constitutes my acknowledgement that I/we have received, read and understood the terms and conditions of this agreement. Furthermore: I/we are acknowledging that I/we can access the electronic communications in the designated formats described above.
